Terms of Use
As stated in Section 18 of these Terms of Use, labeled “Dispute Resolution and Arbitration,” disputes arising out of or relating to these Terms of Service or the Services are subject to binding arbitration and a renunciation of class action rights. Please read this section carefully, since it affects your capacity to go to court and have your individual or collective rights determined.
Parkway Inn & Resort (“we,” “us,” or “our”) is a company that provides a website where users can purchase food and beverages from a number of independent pizzerias (“Pizzerias”). The Pizzeria can be requested to either deliver the customer’s order or make it available for pickup via the Platform.
Any reference to “you” or “your” includes the person who is accessing, using, or engaging in the Platform, as well as that person’s legal representatives, executors, administrators, heirs, and assigns. You represent and warrant that you have the authority to bind to these Terms any business, organization, or other entity that uses the Platform on your behalf. If you accept these Conditions on its behalf, it will be considered to have accepted them in person.
By downloading, installing, or otherwise accessing or utilizing the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. DO NOT USE THE PLATFORM IF YOU DO NOT AGREE WITH THESE TERMS.
Authorization to Use the System
You are granted a limited, non-transferable, non-sublicensable, and revocable license to use the Platform on compatible devices that you own or control, only for your own use, and only in accordance with any applicable laws that pertain to you or your use of the Platform. The acquisition of this license is based on your acceptance and compliance of the following terms and conditions. Parkway Inn & Resort retains the right to revoke this license for any reason and at any time.
Parkway Inn & Resort retains all rights not specifically granted. The Platform may not be modified or transmitted in a manner that permits simultaneous access from multiple devices. Access to the Platform may not be rented, leased, lent, sold, distributed, or sublicensed. If you break these license restrictions or exceed the extent of the license provided by these Terms and Conditions, you may be subject to legal action, financial fines, and intellectual property infringement liabilities. Changes to the Platform will be controlled by these Terms unless they are accompanied by a different license, in which case those terms will apply.
Account Registration and Qualification Standards
To use the Platform, you must be 18 years or older. You represent and warrant to us that you are at least 18 years old, have never been suspended, banned, or otherwise removed from the Platform, and that your registration for and use of the Platform complies with all applicable laws and regulations. Certain Platform features might demand registration. Throughout the account creation process, you may be asked for some identifying information (such as your name, credit card information, e-mail address, phone number, profile image, or other contact information). You promise that any information you provide will always be accurate and current. We may request information to verify your identify and safeguard your account. Throughout the registration process, you will be required to enter a password for security purposes. It is your entire duty to safeguard your login details. If another person acts in your place, you are liable for their conduct.
Your Connections
By registering or placing an order with us, you agree to receive emails and phone calls from us or the pizzeria regarding your order. These emails or text messages may contain both instructive and promotional material. You cannot opt out of receiving transactional or relationship-based communications. If you prefer, we or the pizzeria might send you SMS updates regarding your order. The dissemination of these messages is governed by our SMS Terms & Conditions.
By installing our mobile app on your device, you agree to receive push notifications, which are messages sent to your device even when the app is not running. You can disable the alerts on your phone by visiting the “settings” tab.
